Welcome to Travelscrapbook! Travelscrapbook is a social network for people who love to Travel and create unique photo and media related gifts. With Travelscrapbook you can upload blogs, plot maps and store, share, and print your Photos through our custom product builder and associated photobook creator. In addition you can also upload and create slideshow DVD’s with our slideshow movie creator. Book flights, Hostels and accommodation, we have the right to update and change products and services from time to time. By entering and using our website, you are accepting the terms and conditions listed below and agree to be bound by them. Accepting these terms and conditions creates a binding contract between you and Travelscrapbook. If you should have any questions, please contact info@travelscrapbook.net

We reserve the right at any time to change all or any part of these terms; change the website and services, including by eliminating or discontinuing any content on or feature of the website and services; and change any fees or charges for use of the website and services. Any changes we make will be effective immediately upon notice, which we may provide by any means including, without limitation, posting on the website or by electronic mail. Your continued use of the website and services after such notice will be deemed acceptance of such changes. Please return to this page periodically to check for updates to our policy.

1. / Account Membership

Our use and disclosure of any such information that you provide is governed by our privacy policy. This site is for personal use only. You should always preserve your original Content, or make back-up copies of such Content, on your personal system. You should not use our service as the only repository for your photo, media and audio storage. Please be sure to make back up copies of your personal content

When you create an account, you will be asked to select a username and password. We have the right and may refuse to grant you a username for any reason at our sole discretion. Reasons for this are not limited to but may include impersonations of someone else, illegal use, vulgar language, trademark infringement, etc. By using our hosting service, you will be responsible for keeping your username and password confidential. You also agree not to transfer or resell your use of or access to the service to any third party. You are responsible for restricting access to your computer and agree to accept responsibility for actions that occur under your account. You should immediately notify us unauthorized use or breach of security

Subject to these terms you may open an account with Travelscrapbook by completing the Registration procedure. Once your registration has been accepted (and until your account is terminated) you will be able to upload images, media and audio to our website. During the registration process you will be asked to supply your email address. This will help us to verify your identity on future visits. Should you register using an invalid email address or an email address that belongs to someone else, Travelscrapbook may terminate your account at any time without notice.
Each registration is for a single user only. You will also need to provide a password in order to access your account and the photos, media and audio which have been uploaded to it. We do not permit you to share your password with any other person. You must keep your password secure at all times. You will be responsible for any damage or losses caused by unauthorized access resulting from your failure to keep your password secure.

There is no charge for opening a Free Travelscrapbook account, however there may be charges for other products or services supplied by us as well as our annual fee for (Pro) accounts which will be payable one year from subscription on a year by year basis (Fee subject to change). (Pro) Accounts are non-refundable and termination of subscription will be automatic on failure to re-new a yearly subscription. In respect of prices changes on all products and services throughout the site you will be notified of these charges and changes at the time you request the products or services. When you place an order for some of our products or services, for which there is a charge, these will be processed via our online payment partners PayPal or third party partners in which you may be requested to provide credit card details for payment.
In the event that you supply invalid credit card details or details of a credit card that belongs to someone else, we reserve the right to terminate your account at any time without notice.

2. / Images

Images uploaded to our website must be digital images in formats applicable. For further guidance and information on images and uploading please visit our Help page for image file specifications.

Images uploaded by you or by us on your behalf will (subject to the restrictions in these terms) be available for viewing by you in a photo album accessible through your account using your email address and password. You can share your albums and images with family and friends by allowing them to have access to your albums and images (your "guests"). You can do this either by:

using our website to allow your albums to be accessed by any member of the public; or
using our website to allow your albums to be accessed by guests who you have nominated by inputting their email addresses and or through third party social networks you have requested.

By sharing albums or photo creations you warrant that you have obtained all the necessary third party consents to permit you do so and further that the sharing of the same does not infringe the rights of any third party.

Guests are permitted to buy printed and media created items, submit comments and notify offensive material in respect of those photos which you have given them access to. We will not be responsible for any action taken by your guests who have been given access by you to your albums and images.

You should not nominate any guests if you do not wish to allow them to order printed items which use the images in your photo album.
You may delete images uploaded to our websites by you or by us on your behalf at any time.

3. / Audio

By sharing uploaded audio you warrant that you have obtained all the necessary third party consents to permit you do so and further that the sharing of audio does not infringe the rights of any third party of copyright or legal ownership.

We will not be responsible for any action taken by you or your guests who have been given access by you to your audio albums in the creation of Slideshow Movie files and or products for purchase in relation to audio files.

You should not nominate any guests if you do not wish to allow them to order products which use the audio in your audio albums.
You may delete Audio uploaded to our websites by you or by us on your behalf at any time.

You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses arising out of:
any use by you or your guests of our websites in breach of these terms,
any claim that the uploading or emailing of any audio by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights; or
any claim that the processing, printing downloading or other dealing by us of any audio uploaded or emailed by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights

4. / Uploaded Content, Audio, Video and Images

Although we prohibit the uploading of certain types of image to our website, we do our best to control and monitor the use of our website. However it is possible that images or other material may be missed by us and appear on our website which are unlawful or offensive and contravene our restrictions on content set out above. We are not responsible for such images or material but if you become aware of any such images or material on our website please contact us without delay.

We may at our discretion contact law enforcement authorities if we are made aware that anything unlawful is occurring or has occurred in relation to our website including the uploading or emailing of any images in breach of the above restrictions on content. We may provide copies of any relevant images or material to the law enforcement authorities and in that connection may also give them access to any personal data that is held by us.

We may without notice and at our sole discretion delete or remove any image that has been uploaded, emailed or submitted for printing in breach of these terms.
We may refuse to provide any further services to anyone who breaches these terms of use.

You will indemnify us and our officers and employees against any action, claim, damages, liability, costs and expenses arising out of:
Any use by you or your guests of our website in breach of these terms,
any claim that the uploading or emailing of any images, audio or video files by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights; or
Any claim that the processing, printing, downloading or other dealing by us of any images, audio or video files uploaded or emailed by you or on your behalf is an infringement of any third party's copyright, trade mark or other intellectual property rights

5. / Use of Service / Conduct

User shall not use the service for any of the following activities: (i) content that contains nudity, obscene or pornographic material of any kind; (ii) posting, photos, captions, names, posts or descriptions that convey blatant expressions of bigotry, prejudice, racism, hatred or profanity; (iii) defaming any person or group; (iv) linking to any site that promotes any of the above; (v) uploading material containing any virus or other content that may damage the service, the network, or any other user's equipment or software; (vi) violates any laws, rules, or regulations of any governmental or other administrative organization having authority over the service, or users; (vii) contains copyrighted material without the express permission of the owner. Travelscrapbook shall be the sole judge of online conduct and may delete, move, and edit content for any reason, at any time, without notice. As the user, you are responsible for your content. By using this site, you also understand that you are responsible for your exposure to items you may consider to be offensive and take sole responsibility for it.

6. / Copyrights

You are responsible for all of the images, audio and video you upload, share or copy using the Travelscrapbook service. You must have the legal right to display each image, audio and video that you upload or share, and to copy each image, audio and video that you order prints or photo/media based products of video downloads of. If you believe that there is evidence of a copyright violation on the site, please send an email to info@travelscrapbook.net. In addition, the actions further described below, will constitute grounds for blocking your access to our service, removal of posted material and non-fulfillment of your order (or any part of your order). As condition of your use of this service, you shall not:

Upload, post, order for print, upload, download, email or otherwise transmit any content that is unlawful, harmful, threatening, harassing, defamatory, obscene, vulgar, invasive of another's privacy, hateful, or otherwise objectionable;

upload, download, post, order for print, email or otherwise transmit any content that you do not have a right to transmit under any law or under contractual or fiduciary relationships (such as insider information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements) or any content that infringes any trademark, trade secret, copyright or other proprietary rights of any party;

Harm minors in any way, including, but not limited to, content that violates English or International Law including child pornography laws, child sexual exploitation laws and laws prohibiting the depiction of minors engaged in sexual conduct;

Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through this site;

upload, download, post, email, order for print or otherwise transmit any material that contains software viruses or any other computer codes, files or programs designed to interrupt, destroy or limit the functionality of any computer software;

Interfere with or disrupt (or attempt to interfere with or disrupt) this site or servers or networks connected to this site, or disobey any requirements, procedures, policies or regulations of networks connected to this site;

Provide any information to Travelscrapbook that is false or misleading, that attempts to hide your identity or that you do not have the right to disclose.

Travelscrapbook reserves the right to refuse to fulfill any order, or any part of any order, if it believes that these Terms & Conditions have been violated. In addition, Travelscrapbook reserves the right to disclose any account or order information when it believes in good faith that the law or legal process requires it, or when it is necessary to do so to protect the rights or property of Travelscrapbook or others.

7. / Operation of the Website

We may change the format and content of our website (or any products or services offered by our website) at any time.
We may terminate or suspend the operation of our website (or terminate or suspend provision of any products or services offered through our website) for support or maintenance work, in order to update the content or for any other reason. We may do this at any time and without notice.
You are advised to keep back ups of all material provided to us. In particular, it is up to you to keep backup copies of images uploaded by you or emailed to us. We will not be responsible for keeping backups or for the loss of, deletion or corruption of any images or any other material uploaded onto our websites.

Once you have placed an order for any products or services through our website (including any orders for printed products), the order will not be treated as having been accepted until you receive confirmation from us or third party partners and or affiliates that this is the case. This confirmation may be provided by email or post depending on the Product partners or Affiliates confirmation procedures.

The decision as to whether to accept any order from you is at our sole discretion.
In the event that printed items are produced and prior to dispatch are then discovered to be in breach of these terms, third party product providers may not dispatch the printed items to you or to any guest who ordered the printed items.
To maintain continuity of service we reserve the right for our third party partner in charge of product production and dispatch to use alternative photographic paper products in the production of printed items, to those stated on our websites from time to time.

We will use our reasonable endeavors to reply promptly to all correspondence. Such reply may be by email or by post.

10. / Photographic based printed products

By signing this agreement you understand that uploading photos and content in the creation of Photographic based printed products you take full responsibility and legal personal liability in the content you upload to create these items within our third party integrated product builder. Travelscrapbook works as an Affiliate Partner in providing Photographic based printed products. It is at the sole discretion of Travelscrapbook Limited in respect of dissatisfaction with products provided to you from our Affiliate partner to provide refunds and or replacement products. All customer enquiries, concerns, disputes and returns of products should be made direct to us at info@travelscrapbook.net where upon Travelscrapbook Limited will investigate customer enquiries, concerns, disputes and returns of products and at our sole dissertation replace and or refund customers in respect of dissatisfaction and or damaged products.

Travelscrapbook works solely as an Affiliate gateway to users in creating these products generated within the product builder only. Travelscrapbook takes no responsibility or liability for Photographic content you upload in creating Photographic based printed products and you take full personal responsibility and legal liability for the content you upload. Travelscrapbook does not accept harmful or distasteful content to be uploaded in creating Photographic based printed products and has the right to report, ban and or cancel membership of users found doing so.

11. / Slideshow Movies

In creating the slideshow movie file within our third party partners slideshow movie creator. Using text, photographic, audio and video content you upload and supply, you take full responsibility for the creation and existence of the movie file. Travelscrapbook Limited will provide you with the opportunity to purchase the generated movie file for download for personal viewing only.

In reading and signing this agreement you acknowledge and understand that you take full personal responsibility and liability with the use of this file upon purchase. Should you distribute or share this file unlawfully or without consent of the rightful owner of all or any content, visual or audio, you hold all liability for this and waiver any and all liability in respect of Travelscrapbook Limited.

All customer enquiries and concerns, in respect of movie file downloaded products should be made direct to us at info@travelscrapbook.net

12. / Photobooks

By signing this agreement you understand that uploading photos and content in the creation of Travelscrapbook / Mixbook photobooks you take full responsibility and legal personal liability in the content you upload to create photobook(s).

Travelscrapbook works as an Affiliate Partner in providing Photobooks for our Partners Mixbook Inc. Travelscrapbook Limited takes no responsibility or Liability for dissatisfaction with photobook service or products provided to you from our Affiliate partner. All customer enquiries, concerns, disputes and returns of photobooks should be made direct to Mixbook Inc. Travelscrapbook works solely as an Affiliate gateway to users in creating these products generated within the Mixbook website platform only. Travelscrapbook takes no responsibility or liability for Photographic content you upload in creating Photobook Products and you take full personal responsibility and legal liability for the content you upload. Travelscrapbook does not accept harmful or distasteful content to be uploaded in creating Photobooks and has the right to report, ban and or cancel membership of users found doing so.

13. / Bookings

You accept and understand that all bookings received and purchased through Travelscrapbook via our Affiliate partners for flights, accommodation, travel Insurance related products and services are the sole responsibly and liability of you and the third party Affiliate upon purchase and not Travelscrapbook Limited.

Travelscrapbook Limited is an Affiliate partner only and works as a gateway to these products and services only, as such we take no liability for dissatisfaction of products and or services you purchase through our website. Should you have any enquiries or concerns in respect of your booking you understand that you contact the third party partner direct and not Travelscrapbook Limited

14. / Representations and Warranties

You as the user represent and warrant that: the content will not infringe upon any copyright, right of publicity or privacy, or any other proprietary right of any person, whether contractual, statutory or common law. You agree that neither Travelscrapbook nor any of its directors, officers, employees, partners or agents shall be liable for any damages, whether direct, indirect, consequential or incidental, arising out of the use of, or the inability to use, the submitted content. You further acknowledge that you are legally responsible for any challenges made by a third party regarding copyright in the submitted content.

15. / Term and Termination Term

This agreement is an at will agreement that begins upon sign-up registration and continues indefinitely unless terminated herein. Termination by User: User may terminate this agreement at any time. Termination by Travelscrapbook: Travelscrapbook may terminate this Agreement with or without cause, at any time upon fifteen (14) days prior written notice to User. Travelscrapbook also may terminate this Agreement immediately upon material breach of Section 5 ("Use of Service/Conduct").

16. / Cancellation

You may cancel your account by contacting us by email. You may be asked to provide further proof that you are the holder of the account. Your account will be cancelled as soon as reasonably practicable following receipt of your email or letter.
We may cancel your account without notice at our sole discretion.
Once your account is cancelled, your photo, media and audio album will be removed from our website and your password will no longer enable access to the password protected areas of our websites.

17. / Questions, Concerns or Complaints

Complaints or claims must be notified to us within 28 days of receipt of printed products ( Not Photobooks, see section 12), or in the case of non-delivery, in a reasonable time after the products were expected to arrive.

18. / Law and Jurisdiction.

These terms (and the provision of products and services by us) are governed by and to be interpreted in accordance with English law. In the event of any dispute arising in relation of these terms or in relation to the provision of any products and services by us the English courts will have non-exclusive jurisdiction over such dispute although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or other relevant country.
